Terms of Service

1. Agreement to Terms

By accessing or using Scout Pro ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service, including coaches, parents, family members, and team administrators.

2. Description of Service

Scout Pro is a basketball team management platform that provides:

• Game statistics tracking and analysis
• Team roster management
• Schedule and event management
• Team communication tools
• Player performance analytics

3. User Accounts

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to create an account. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

4. User Roles and Permissions

The Service includes different user roles with varying permissions:

• Head Coach: Full access to all team features, including roster management, game scoring, statistics, and team settings.
• Assistant Coach: Can start games, record statistics, and access team management features.
• Stat Keeper: Can start games and record statistics.
• Parent: Can view team information, schedules, and statistics as permitted by the coach.
• Family/Friend: Limited viewing access as permitted by the coach.

Coaches are responsible for managing team membership and controlling what information is visible to other team members.

5. Acceptable Use

You agree NOT to use the Service to:

• Violate any applicable laws or regulations
• Harass, abuse, or harm another person
• Share inappropriate, offensive, or harmful content
• Impersonate others or misrepresent your affiliation with a person or entity
• Attempt to gain unauthorized access to other users' accounts or data
• Interfere with or disrupt the Service or servers
• Use the Service for any commercial purpose without our consent
• Collect or harvest any information from other users without consent
• Upload viruses or malicious code

6. User Content

"User Content" includes any data, text, information, or materials you submit to the Service, including team names, player information, game statistics, and messages.

You retain ownership of your User Content. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, and distribute your User Content solely for the purpose of operating and improving the Service.

You are solely responsible for your User Content and represent that:

• You have the right to submit the content
• The content does not violate any third party's rights
• The content complies with these Terms and all applicable laws

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and share your information. By using the Service, you consent to our collection and use of data as described in the Privacy Policy.

8. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by Scout Pro and are protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service or its content without our written permission.

9. Third-Party Services

The Service may contain links to or integrate with third-party websites or services (such as Google Calendar). We are not responsible for the content, privacy policies, or practices of third-party services. Your use of such services is at your own risk.

10. Disclaimers

We do not guarantee the accuracy or completeness of any statistics, analytics, or other information provided through the Service. Game statistics are entered by users and we are not responsible for errors in user-entered data.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCOUT PRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us, if any, for the Service during the twelve months prior to the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Scout Pro, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service or violation of these Terms.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date.

Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions.

Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Union County, New Jersey, and you consent to the personal jurisdiction of such courts.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Scout Pro regarding your use of the Service and supersede any prior agreements.
